Client:

1. Services Provided:

The Pool Service Provider agrees to provide the following services to the Client's swimming pool located at the Client's address:

Regular Maintenance- (Weekly/Bi-Weekly):

o Skimming debris from the water surface

o Vacuuming the pool floor

o Brushing pool walls and steps

o Emptying skimmer and pump baskets

o Testing and balancing pool water chemistry (pH, alkalinity, calcium hardness, sanitizer levels, etc.)

o Adding necessary chemicals (chemicals will be billed as per Section 3)

o Backwashing the filter (as needed)

o Swap Cartridges (as needed)

o Inspecting equipment for proper operation

Chemical Service (Weekly/Bi-Weekly):

o Testing and balancing pool water chemistry

o Adding necessary chemicals (chemicals will be billed as per Section 3)

Opening Service (Annual):

o Removing winter cover

o Remove Winter Plugs/Install Returns & Skimmer Basket(s)

o Install Rails/Ladders

o Starting up the filtration system

o Inspecting equipment

Closing Service (Annual):

o Lowering water level (if applicable)

o Adding winterizing chemicals

o Blowing out water lines

o Plugging returns and skimmers

o Covering the pool

o Winterizing equipment (pump, filter, heater, etc.)

Equipment Repair: (Repairs will be quoted separately and performed upon Client approval)

Equipment Installation: (Installations will be quoted separately and performed upon Client approval)

Sand Change: Billed at labor rate of $1.00/lb of filter media removed from filter plus replacement filter media cost. (I.e. 300lb filter media change = $300 removal cost + filter media cost [media cost varies]).

Green 2 Clean: Billed at an hourly labor rate and chemical cost.

2. Service Schedule:

• Regular maintenance services will be performed on [Monday through Friday] between the hours of [8am] and [7pm], weather permitting. The exact time may vary due to unforeseen circumstances.

• The Client acknowledges that holidays or unforeseen circumstances may require adjustments to the service schedule. The Pool Service Provider will make reasonable efforts to notify the Client of any significant changes.

• Opening service will be scheduled for an approximate date via customer request.

• Closing service will be scheduled for an approximate date via customer request .

• Requests for additional or unscheduled services will be addressed based on the Pool Service Provider's availability and may incur additional charges.

3. Fees and Payment:

Regular Maintenance Fee: Shall be billed Monthly via email and USPS.

Chemicals: Chemicals used for regular maintenance will be billed monthly at current rates on separate line of monthly invoice. The Client will be provided with an itemized list of chemicals used upon request [or periodically].

Opening Service Fee: $400 (inground w/ no water features), $325 (above-ground)

Closing Service Fee: $425 (inground w/ no water features), $350 (above ground).

Equipment Repair/Installation: Fees for repairs and installations will be provided in a separate written estimate and require Client approval before work commences.

Late Payment Fee: Payments required 7 days after receipt of bill unless discussed prior. A late charge of 10% will be added to the total amount owed if not paid within 7 days and 5% every following 7 days.

Payment Method: The Client agrees to pay the Pool Service Provider via [Accepted Payment Methods, e.g., check, credit card, online payment].

Billing Cycle: Invoices will be issued [Monthly for Regular Maintenance], [Upon Completion for Non Regular Maintenance].

Price Adjustments: The Pool Service Provider reserves the right to adjust service fees annually with [14] days' written notice to the Client.

4. Client Responsibilities:

• Provide the Pool Service Provider with safe and unobstructed access to the pool and equipment.

• Maintain the water level of the pool as recommended by the Pool Service Provider.

• Ensure that pets are secured and do not interfere with service.

• Notify the Pool Service Provider promptly of any issues with the pool or equipment.

• Provide accurate contact information and promptly update any changes.

• Ensure all gates and access points are unlocked on scheduled service days.

5. Pool Service Provider Responsibilities:

• Provide the agreed-upon services in a professional and timely manner.

• Use appropriate chemicals and equipment for pool maintenance.

• Adhere to safety standards and regulations.

• Communicate any significant issues or concerns regarding the pool or equipment to the Client.

• Maintain appropriate insurance coverage.

6. Term and Termination:

• This Agreement shall commence on [Start Date] and shall continue [for a specific term, e.g., month-to-month, one year] unless terminated by either party as outlined below.

• Termination by Client: The Client may terminate this Agreement with [7] days' written notice to the Pool Service Provider.

• Termination by Pool Service Provider: The Pool Service Provider may terminate this Agreement with [7] days' written notice to the Client, or immediately for non-payment or breach of this Agreement by the Client.

• Upon termination, the Client shall pay the Pool Service Provider for all services rendered up to the date of termination.

7. Limitation of Liability:

To the fullest extent permitted by law, the Pool Service Provider's liability for any claim arising out of or related to this Agreement shall be limited to the total amount paid by the Client to the Pool Service Provider under this Agreement during the [Number] months immediately preceding the event giving rise to the claim. The Pool Service Provider shall not be liable for any indirect, incidental, consequential, or punitive damages.

8. Indemnification:

The Client agrees to indemnify and hold harmless the Pool Service Provider, its employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the Client's breach of this Agreement, the Client's negligence, or any unsafe conditions at the Client's property that cause injury to the Pool Service Provider or its employees or agents.

9. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin. Any legal action arising out of or relating to this Agreement shall be brought in the state or federal courts located in Wisconsin.

10. Entire Agreement:

This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications and proposals, whether oral or written, relating to the subject matter hereof.

11. Amendments:

Any amendments to this Agreement must be in writing and signed by both parties.

12. Severability:

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
